I recently booked visa appointment at Chennai.
1. Use IE. I had issues with firefox
2. You will be allowed to pick the appointment date at the very end. In fact that is the last step of the online visa appointment booking process.

I agree with you.
We are apply independently since both of us are in H1B status
I presume that this marriage in foreign country may not be valid because the marriage was neither registered in India nor done according to Foreign Marriage Act, 1969, since both of us are citizen of India at this present time.
However; we are working out with our parents to get married and register in India, but unsure when this will happen.
Youre Thoughts please?
It is better to contact a attorney or other relavent family/marraiage law counsulars. It is very important. USCIS treats if vigorosly this issue, as marriage realted fraud is very high in immigration benefits, particularly in FB catagory.

UK and other countries in Europe must be smoking pot to think that they tap into the pool of skilled migrant workers returning from US. These people are returning back to their home countries primarily due to the recent advancements in their own countries, and to some extent due to the GC & visa mess in US.
The working (& living) condition in Europe is not as good as it is in US, and the scope for personal advancement is not as good as it is in India, China, Brazil, and many other countries. Why would anyone do a stop over in between? And that too in UK - the country with the most racism than any other European country, may be with the exception of Germany. Just look at how it reversed its GC policy (a scheme called by some other BS name).
Believe me - I'm speaking from more than 8 years of living and extensive travel in that region. You don't want to do that.
Not only India, also Britain and many more want to benefit from the high-skilled workers that the U.S. is already kicking out so they can let in more illegal Salvadoran maids:

I guess all the EB2 june filers might get approvals rather than EB3 June..right??
Has anyone in the EB3 category (june 2007 filers) got any approvals??
Cheers!!
I agree with you. EB2 filers should not have any problem after USCIS solves all this receipting mess. Any one who filed in June and is already approved must have been pre-adjudicated, which means both name check and finger printing must have happened before the new fiscal year began. Anyway, from our perspective and not USCIS'S, EB3 has a long way to go.
My details:
PD= 03/2005
I-140: Approved
RD: June 26, 2007
FP: Sept.8, 2007
EAD: approved in 44 days

Hi,
My wife is waiting on her H-1B approval. She is on a H-4 currently. The company that sponsored her H-1B is an american fortune 500. This will be her first H-1B and she is in the USA for 11 months now. I have a few questions:
1. To apply for the SSN she would need the original I-797 and the I-94, correct?
2. After she applies at the SSN office, will she be able to see the number immediately (and wait for the card) ?
3. How long does it normally take them for issuing a SSN for a person like her? (H-4 to first time H-1B)?
Thanks in advance.

There is no time to think at this situation. If the labor says BS+3 years then you need that exact same experience to qualify.

You raise an excellent question--and one to which, at present there is no authoritative answer. The statute and regulations are silent on the issue and USCIS has not addressed it in any policy memo.
I would argue that because the purpose of AC21 is to protect protect foreign nationals (and the US employers who depend on them) from the uncertainty and disruption resulting from lengthy and unpredictable quota delays, denial of the I-485 should not result in revocation of an approved H-1 extension. This is especially true if a non-frivolous motion to reopen and reconsider the I-485 denial has been filed. I am not aware of any AC21 H-1 being revoked by USCIS based on an I-485 denial.
Moreover, an I-485 denial does not invalidate the underlying I-140 which would remain valid unless revoked for fraud or misrepresentation. For example, if the I-485 is denied because it was erroneously filed at a time when the PD was not current or because the medical indicated that the applicant had infectious, untreated tuberculosis, consular processing would still be an option.

Ramba,
Thanks for responding. What happens when we get a RFE or NOID. Could we respond by ourself then? My case is not complicated at all. As straight forward as it could get.
I am going to search in this forum for sample covering letter. But if anybody has the info handy please let me know.
Thanks guys!
-samcam
RFE and NOID come with a color sheet of paper with your details and some USCIS internal codes for your case. You can respond by yourself and put the sheet on top - this is for the mailroom to handle your case

Without a job offer from a national lab, it makes it hard to say why I want to skip the labor certification. Companies that need work of national interest now first ask for a green card before they give a job offer in a chicken and egg game. That I am nearing the end of 6-ye H1B may not be good enough reason to bypass labor. The most reasonable argument I can think of is that my stopping work will harm US national interests and no one else can do that work because I am special. What do you think?

no idea..I am yet to transfer my license to OK. one bad experience that I had lately..I walked into IRS office to check on ITIN/SSN issue and I was not allowed to go inside. They said if I lived in OK I need to have an OK ID. No other state ID would be accepted. This is if you have moved here for more than 30 days.

I could find this useful. I am in my 6th year expiring June 1, 2007. My employers are just about to file LC, so I guess being able to process I140 by premium will enable me file for a three year extension before my current stay expires.
May be they did it for those who are in 6th year and did not file LC 365 day before 6 year expiry.. Now they can file LC in perm get approval fast and then get Premium 140 to get 3 year extension on H1B.

Advocacy Action Item August 2009 - update
The summer August recess is in progress and the lawmakers are still in their constituencies. This is an opportunity for us to meet with them and address our issues and present solutions in preparation for the upcoming CIR. We must push for our agenda to get our provisions in the base bill as CIR is being drafted currently. If we do not get our provisions in the base bill then it is much harder to get them attached to the bill in the form of amendments.
IV therefore requests its members, to continue to call up and start scheduling lawmaker meetings NOW. Please take appointments with your local lawmakers of both houses of Congress. You can find more information about how to reach your lawmaker in this guide http://immigrationvoice.org/media/HowTo_Guide_MeetLawmakers.doc
our members have been taking appointments and so far the feedback has been extremely positive. These meetings have enabled us to enlighten the lawmaker offices and engage in constructive dialog that not only addresses our issues and concerns but also provides solutions to the backlogs.
As communicated earlier, we have created multiple documents and support material that will go into your Advocacy Packet for you to carry for these lawmaker meetings. We have also created a Lawmaker Appointment Book
http://immigrationvoice.org/index.php?option=com_content&task=view&id=80&Itemid=36
where you will post the details of your lawmaker appointment and we will provide you with the advocacy packet. More details of this action item can be found on this thread:
http://immigrationvoice.org/forum/forum85-action-items-for-everyone/294611-iv-action-item-advocacy-month-august-2009-a.html
In summary there are two parts to this action item
1) Please continue to take the appointments with your lawmakers. We need to maximize the remaining August recess days to get as many meetings as possible with either the lawmakers or their close aides. Once you take the appointment, update the details in the Lawmaker Appointment Book that is available on http://immigrationvoice.org/index.php?option=com_content&task=view&id=80&Itemi d=36 and you will receive the Advocacy Packet that you will need to take to the meetings.
2) Once you have your meetings, please email the details and feedback to info@immigrationvoice.org to help us follow up with their DC office with your feedback. Your detailed feedback will also help other members in their upcoming meetings with their representatives.
We must push ourselves harder and stronger in this month if we have to see the light at the end of the tunnel. Advocacy is an integral, essential and important part of democracy and we must exercise our first amendment right. We not only are highly skilled and are high income individuals that but we are truly the best and the brightest Future Americans that contribute significantly to the progress of America.

IV = I+We : The Importance of Grass-Roots Organization
Immigration Voice is a grassroots organization, which means, every member in the community plays an important role towards resolving our issues and achieving our goals. Our members are highly skilled, well educated and extremely talented who continue to contribute towards the success of the organization. Our membership base is large and growing every day. The best way to organize ourselves so that our efforts can be effective and yield desired results is by joining state chapters and actively participating in grassroots efforts. State chapters play a very important role in shaping the organization. State chapters organize conference calls, meetings, social gatherings, grassroots advocacy, publicity campaigns, and media campaigns, generate awareness and coordinate many other activities. State chapters also train and mentor members and organize meetings with local lawmakers to discuss our issues, which is the most important aspect of grassroots advocacy. When more people meet with local lawmakers of their constituency and apprise them of our issues, the better will be their understanding of our issues and goes a long way towards aiding our ongoing advocacy efforts. Voicing our opinions and concerns in a peaceful manner is the American way of doing things and Immigration Voice is the platform for future Americans like us to voice our opinions and concerns.
State chapters organize workshops, participate in community events like fairs and marathons, and help arrange media interviews, organize advocacy events like lawmaker meets and rallies, help in raising funds towards advocacy and running the organization. State Chapter members are always verified by the chapter leaders. Most often, the core team shares updates with chapter leaders who in turn share these updates with the chapter members. Chapter leaders keep the members of their state involved, recruit more members and help organize activities and events. Besides joining and participating in state chapters, we need other active volunteers to join us in different teams which are working in specific area like the media group, the newsletter group, the advocacy group etc. Each of these groups is led by dedicated members who work with members in formulating IV documents and strategies.
We also want to urge our members to generously contribute to our cause. We as a non-profit organization depend on your contributions to work on various media and advocacy activities. By quoting the famous words of Martin Luther King Jr. The time is always right to do what is right. We request our members to join a state chapter by following the link
http://immigrationvoice.org/index.php?option=com_content&task=view&id=72&Itemid=52
and look for your state chapter information. If your state chapter does not exist or is not active, you can start the chapter by contacting Immigration Voice at info@immigrationvoice.org . We also request our members to contribute to our cause by logging into IV website and going to following link http://immigrationvoice.org/forum/misc.php?do=donate
